Conditions of Use for the Regulatory Services Platform

This Agreement governs the Conditions of Use pursuant to which users will have access to the Regulatory Services Platform (RSP) that supports organizations to report mandatory data and/or voluntary data for regulatory and non-regulatory programs administered by Environment and Climate Change Canada (ECCC). The purpose of RSP is to streamline client management, allowing users to register their organization and submit data using one account for multiple environmental instruments.

  1. Acceptance of RSP Conditions of Use
    1. This Agreement sets out the Conditions of Use pursuant to which ECCC will make RSP available to Users.
    2. By clicking “Accept” at the end of this Agreement, each user:
      • agrees to be bound by this whole Agreement;
      • acknowledges having read the Privacy Notice Statement for RSP located at the footer of the webpage.
  2. Amendment
    1. ECCC reserves the right to modify this Agreement at any time without prior notice. However, such modifications will only be effective after the User will first have the chance to read the amended Conditions of Use and agree, by clicking once again on the “Accept” button, with the new set of Conditions of Use.
  3. Responsibilities and Obligations of the Users
      All users of the platform are fully responsible for:
      • any use of RSP that is in breach of this Agreement, including such use by any of their registered users internal to ECCC and external registered users;
      • ensuring that all information provided to ECCC through RSP is true, accurate, current, complete and in compliance with the Canadian Environmental Protection Act, 1999;
      • informing ECCC of any inaccuracies with respect to any information entered in RSP;
      • implementing processes or mechanisms supporting accurate validation of the identity of their registered users;
      • keeping the RSP login information confidential.
    1. The registered users and the general public can open a case to reach out to ECCC for any enquiries.
    2. Each user must notify ECCC if it knows or suspects that:
      • any provision of this Agreement has been or may have been contravened whether by act or omission;
      • any breach of security to RSP has occurred whether it impacts the security or integrity of RSP or not;
      • confidentiality of RSP login information is or has been compromised or that an Account has been or may have been accessed or used without authorization.
    3. Each user agrees to:
      • obtain and to properly use any computer equipment, software and communications services necessary to use RSP;
      • maintain the confidentiality of the RSP Login Information;
      • not seek to access parts of RSP otherwise not normally accessible, or not otherwise attempt to defeat security features;
      • not attempt to access RSP once the access has been blocked, unless and until any conditions related to the block have been removed;
      • not facilitate or encourage any violation of these Conditions of Use.
  4. Blocking the access to RSP and Termination of this Agreement
    1. If a User breaches these Conditions of Use and fails to comply with any of their obligations under this Agreement, the Minister may block that User’s access to RSP. The Minister will notify that User about the breach and provide a reasonable time period for the User to cure the breach or to provide another solution satisfactory to the Minister;
    2. Upon termination of this Agreement, the User's access to RSP will be terminated.
    3. regulatory requirements, including reporting, will remain the responsibility of the required party, even if RSP access is revoked.
  5. Minister’s and ECCC’s Rights and Responsibilities
    1. The Minister may publicly post information that it is authorized or required to publish under the Canada Environmental Protection Act, 1999;
    2. ECCC is entitled to rely on and act upon the information it receives through RSP in relation to the User. In the event ECCC becomes aware of an error with respect to the information of a User, ECCC may notify that User directly.
  6. Our commitment to accessibility
    1. The Government of Canada is committed to achieving a high standard of accessibility as defined in the Standard on Web Accessibility and the Standard on Optimizing Websites and Applications for Mobile Devices. In the event of difficulty using our web pages, applications or device-based mobile applications, contact us for assistance or to obtain alternative formats such as regular print, Braille or another appropriate format.
  7. Providing content in Canada’s official languages
    1. The Official Languages Act, the Official Languages (Communications with and Services to the Public) Regulations and Treasury Board policy requirements establish when we use both English and French to provide services to or communicate with members of the public. When there is no obligation to provide information in both official languages, content may be available in one official language only. Information provided by organizations not subject to the Official Languages Act is in the language(s) provided.
  8. Disclaimer
    1. RSP will be available seven days a week, twenty-four hours a day, except
      • during regularly scheduled maintenance or repair; or
      • because of events beyond the control of ECCC, or that ECCC could not have reasonably prevented by means of controls, compromise, disaster recovery procedures or business continuity procedures.
  9. Trademark notice
    1. The official symbols of the Government of Canada, including the Canada wordmark, the Arms of Canada, and the flag symbol may not be reproduced, whether for commercial or non-commercial purposes, without prior written authorization.
  10. Third Parties
    1. No third party shall have any right to enforce any terms of these Conditions of Use.

Privacy Notice

Environment and Climate Change Canada (ECCC) is committed to protecting the privacy rights of individuals, including safeguarding the confidentiality of information provided by individuals and institutions.

Personal information submitted through the Regulatory Services Platform is collected under the authority of the Canadian Environmental Protection Act, 1999, the Fisheries Act and related legislation or regulations.

Personal information collected on the Proof of Authority form is used to provide the stakeholder and ECCC with the assurance that individuals who enroll in the Regulatory Services Platform to access various online services have been appropriately authorized by the stakeholder. This information will be accessible to ECCC staff, or those associated to the individual's profile, as may be required by ECCC for the confirmation of regulatory compliance or enforcement under the responsibility of ECCC.

If an individual refuses to provide the required information, the individual will be unable to submit a request for any online services supported by the Regulatory Services Platform.

Information about the functions, programs, activities and related information holdings of government institutions is subject to the Access to Information Act and the Privacy Act. Personal information collected by ECCC and the Government of Canada is protected from disclosure to unauthorized persons and/or agencies pursuant to the provisions of the Privacy Act and its regulations. Individuals to whom the personal information pertains have the right to the protection of, correction, and access to their personal information under the Privacy Act, subject to certain exceptions and exemptions. Upon request, individuals may be given access to their file, have incorrect information corrected or have a notation attached.

For inquiries concerning the treatment of personal information in the custody of ECCC, individuals may contact the ECCC’s Access to Information and Privacy Office at ECATIP-ECAIPRP@ec.gc.ca for access to their personal information pursuant to the provisions of the Privacy and Access to Information Acts. Individuals have the right to file a complaint to the Privacy Commissioner of Canada regarding the ECCC’s handling of their personal information.

The personal information collected will be retained and disposed of in accordance with the ECCC’s retention and disposal schedule.
